Welcome to Scenema AI. These Terms of Service ("Terms") govern your access to and use of the Scenema AI platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

IMPORTANT: The Service uses artificial intelligence to generate video content. You are solely responsible for ensuring your use complies with all applicable laws and does not infringe on the rights of others.


1. Acceptance of Terms

By creating an account or using the Service, you represent that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Description of Service

Scenema AI is an AI-powered video generation platform that allows users to:

  • Create video content using artificial intelligence
  • Generate images, speech, and visual effects
  • Edit and export video projects

The Service uses third-party AI providers and infrastructure to process and generate content. Your use of the Service is also subject to the acceptable use policies of these providers.


3. User Accounts

3.1 Account Creation

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.


4. Acceptable Use Policy

4.1 Permitted Use

You may use the Service to create video content for lawful purposes, including personal, educational, commercial, and creative projects.

4.2 Prohibited Content and Activities

You agree NOT to use the Service to create, upload, or distribute content that:

Deepfakes and Impersonation

  • Depicts real individuals without their explicit consent
  • Creates false or misleading representations of real people
  • Impersonates any person or entity
  • Could reasonably be mistaken for authentic footage of real events

Illegal and Harmful Content

  • Contains child sexual abuse material (CSAM) or sexualizes minors in any way
  • Depicts non-consensual intimate imagery
  • Promotes terrorism, violence, or illegal activities
  • Constitutes harassment, bullying, or threats against individuals
  • Contains hate speech targeting protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability, etc.)

Fraud and Deception

  • Creates fraudulent or deceptive content intended to mislead
  • Generates fake news or disinformation
  • Facilitates scams, phishing, or financial fraud
  • Manipulates or deceives viewers about the nature or origin of content

Intellectual Property Violations

  • Infringes copyrights, trademarks, or other intellectual property rights
  • Uses copyrighted material without authorization
  • Violates the rights of publicity or privacy of any third party

Platform Abuse

  • Attempts to circumvent content filters or safety measures
  • Uses automated systems to access the Service without permission
  • Interferes with or disrupts the Service or its infrastructure
  • Reverse engineers, decompiles, or attempts to extract source code

4.3 AI-Generated Content Disclosure

We strongly encourage you to disclose when content has been generated or substantially modified using AI, particularly when sharing publicly. Some jurisdictions may require such disclosure.

4.4 Consent Requirements

When creating content featuring identifiable individuals (even fictional representations based on real people), you must:

  • Obtain explicit written consent from the individual(s)
  • Be able to provide proof of consent upon request
  • Respect the individual's right to withdraw consent

5. Content Ownership and Licenses

5.1 Your Content

You retain ownership of:

  • Content you upload to the Service ("Input Content")
  • Content generated through your use of the Service ("Output Content")

Subject to compliance with these Terms and applicable third-party provider terms.

5.2 License to Scenema AI

By using the Service, you grant Scenema AI a worldwide, non-exclusive, royalty-free license to:

  • Host, store, and display your content as necessary to provide the Service
  • Process your content through AI systems to generate Output Content
  • Create backups and copies for operational purposes
  • Use anonymized and aggregated data to improve the Service

This license terminates when you delete your content or close your account, except for content that has been shared publicly or with other users.

5.3 Third-Party AI Providers

The Service uses third-party AI providers to generate content. Your use of the Service is subject to the acceptable use policies of these providers. Content you create may be subject to the terms of these providers regarding generated content.

5.4 No Guarantee of Exclusivity

AI-generated content may be similar to content generated for other users. We do not guarantee that Output Content will be unique or exclusive to you.


6. Content Moderation and Enforcement

6.1 Monitoring

We reserve the right, but are not obligated, to monitor, review, and remove content that violates these Terms. We may use automated systems and human review to identify prohibited content.

6.2 Content Removal

We may remove or disable access to content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

6.3 Account Actions

For violations of these Terms, we may:

  • Issue warnings
  • Temporarily suspend your account
  • Permanently terminate your account
  • Report violations to law enforcement
  • Cooperate with legal investigations

6.4 Repeat Infringers

We will terminate accounts of repeat infringers in appropriate circumstances.


7. Intellectual Property

7.1 Scenema AI Property

The Service, including its design, features, and content (excluding user content), is owned by Scenema AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

7.2 DMCA and Copyright Claims

We respect intellectual property rights and respond to valid takedown notices under the Digital Millennium Copyright Act (DMCA) and equivalent laws in other jurisdictions.

To submit a copyright infringement claim, contact us at legal@scenema.ai with:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief that use is not authorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

7.3 Counter-Notification

If you believe your content was wrongfully removed, you may submit a counter-notification with the required information under the DMCA.


8. Payment and Subscriptions

8.1 Fees

Certain features of the Service require payment. You agree to pay all fees associated with your use of the Service.

8.2 Billing

Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees incurred.

8.3 Refunds

Refunds may be provided at our sole discretion. Fees are generally non-refundable except as required by law.

8.4 Changes to Pricing

We may change our pricing at any time. Price changes for subscriptions will take effect at the start of the next billing cycle.


9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 AI Limitations

We do not guarantee that:

  • AI-generated content will be accurate, complete, or suitable for any purpose
  • The Service will be uninterrupted or error-free
  • Content will meet your expectations or requirements
  • Generated content will be free from bias or objectionable elements

9.3 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services integrated with the Service.


10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENEMA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

10.2 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

10.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.


11. Indemnification

You agree to indemnify, defend, and hold harmless Scenema AI, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Content you create or upload
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@scenema.ai to attempt to resolve the dispute informally.

12.2 Arbitration Agreement

Any dispute not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in the state of Delaware, USA, or remotely as agreed.

12.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

12.4 Exceptions

Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property disputes.


13. General Provisions

13.1 Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

13.2 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

13.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

13.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scenema AI regarding the Service.

13.5 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.6 Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
